Terms of Service

These Terms of Service (“Terms”) govern your use of the ProxyShare mobile application (“App”) and related services (“Services”) operated by ProxyShare (“we”, “us”, “our”). By installing, accessing, or using the App, you agree to be bound by these Terms in their entirety. If you do not agree, do not use the App.

1. Eligibility

• You must be at least 18 years of age or the age of majority in your jurisdiction to use ProxyShare.
• You must have legal authority over the device(s) and internet connection(s) used with ProxyShare.
• You must not be located in a jurisdiction where participation in bandwidth-sharing services is prohibited by law.

2. Service Description

ProxyShare enables you to share your device's unused internet bandwidth with our network. Your device acts as a proxy exit node, routing web traffic from our verified business customers (e.g., for web scraping, price monitoring, ad verification, and market research). In exchange, you earn compensation based on the volume of bandwidth shared.

3. Internet Connection & Data Usage

• Unlimited data plans recommended. ProxyShare is designed for use with unlimited internet plans (Wi-Fi or mobile data). We strongly discourage users with capped or metered internet plans from participating, as ProxyShare will consume bandwidth that counts toward your data allowance.
• You are solely responsible for any data overages, throttling, or additional charges imposed by your Internet Service Provider (ISP) or mobile carrier as a result of using ProxyShare.
• ProxyShare is not liable for any costs, fees, or penalties related to exceeding your data plan limits.
• You may set a monthly bandwidth cap within the App to limit how much data ProxyShare shares from your device.
• You may pause or stop sharing at any time from within the App.

4. Earnings & Compensation

ProxyShare uses a progressive tiered payout model based on the total bandwidth you share per calendar month:

Additionally, monthly milestone bonuses are awarded when your device reaches the following thresholds in a calendar month:

• Maximum total milestone bonuses per device per month: $40.00.
• Rates and bonuses are subject to change. We will provide at least 30 days' advance notice before any rate changes take effect, via the App and/or email.
• Earnings are calculated based on our server-side bandwidth measurements, which are final and binding.
• Bandwidth volume is measured as the sum of upstream and downstream bytes routed through your device.
• Marketing materials that reference “up to $0.25 per GB” refer to the highest tier rate. Actual earnings depend on your monthly volume.

5. Withdrawals & Payouts

• The minimum withdrawal amount is $25.00 USD.
• Withdrawals are processed via PayPal, Revolut, Wise, or bank transfer, at your choice.
• To request a withdrawal, use the “Request Withdrawal” button in the App (available when your balance reaches the minimum threshold).
• Withdrawals are processed manually within 5 business days of the request.
• You are responsible for providing accurate payment details. ProxyShare is not liable for funds sent to incorrect accounts due to information you provided.
• Transaction fees charged by the payment provider (if any) are your responsibility.
• ProxyShare reserves the right to withhold or reverse earnings if fraudulent activity, manipulation, or violation of these Terms is detected.

6. Acceptable Use

By using ProxyShare, you agree to:

• Use the App only on devices you own or have explicit authorization to use.
• Not attempt to manipulate, falsify, or artificially inflate bandwidth usage or earnings (including but not limited to: routing your own traffic through your device, using emulators, or running multiple instances on the same network to simulate distinct devices).
• Not reverse-engineer, decompile, disassemble, or tamper with the App.
• Not use the App in any manner that violates applicable local, national, or international law.
• Maintain a reasonably stable internet connection during active sharing sessions.
• Keep the App updated to the latest version available on Google Play.

7. Traffic & Content

• All traffic routed through your device is encrypted (HTTPS). ProxyShare does not inspect, log, or store the content of traffic passing through your device.
• ProxyShare applies traffic filtering to block access to illegal content, financial services, government sites, and other high-risk categories.
• All proxy customers undergo identity verification (KYC). ProxyShare does not knowingly allow its network to be used for illegal purposes.
• Despite our safeguards, we cannot guarantee that 100% of traffic routed through your device will be lawful. ProxyShare assumes liability for the traffic routed through its network and will cooperate with law enforcement if required.
• If you receive a complaint from your ISP or carrier related to ProxyShare traffic, contact us immediately at legal@proxyshare.app and we will assist in resolving the issue.

8. Device & Battery

• ProxyShare is designed to minimize battery and resource usage. However, any background application will consume some battery and processing power.
• ProxyShare is not responsible for any wear, degradation, or damage to your device resulting from the normal operation of the App.
• For optimal performance, we recommend disabling battery optimization for ProxyShare in your device settings.

9. Account Termination & Suspension

• We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in fraudulent or abusive behavior.
• Upon termination for cause, any unpaid earnings may be forfeited if the account was involved in fraudulent activity.
• Upon termination without cause (e.g., service discontinuation), any unpaid legitimate earnings will be paid out within 30 days, provided the balance meets the minimum withdrawal threshold.
• You may delete your account and stop using the App at any time. Outstanding earnings above the minimum threshold will be paid upon request.

10. Limitation of Liability

• ProxyShare is provided “as is” and “as available” without warranties of any kind, express or implied.
• We do not guarantee uninterrupted service, specific earnings levels, or that the App will be free of errors.
• Our total aggregate liability to you for any claims arising from or related to these Terms or the Services shall not exceed the total amount paid to you by ProxyShare in the 12 months preceding the claim.
• In no event shall ProxyShare be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or data overage charges.

11. Indemnification

You agree to indemnify and hold harmless ProxyShare, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the App.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated with at least 30 days' advance notice via the App and/or email. Continued use of the App after the effective date constitutes acceptance of the updated Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands. Nothing in these Terms affects your statutory rights as a consumer under applicable EU consumer protection law.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
